Four firms can review the same automotive-software profile and return two yeses and two nos. That does not automatically mean the case is a coin flip. It often means the firms use different intake rubrics, risk tolerances, or delivery models.
The useful comparison is the case theory behind each answer.
Start with the proposed endeavor
“I work in automotive software” is an occupation, not yet a proposed endeavor. The case needs a more specific account of the work the applicant plans to advance and the problem it addresses.
Depending on the actual record, that might involve safety-critical vehicle software, cybersecurity, resilient manufacturing systems, advanced driver-assistance validation, or standards work. The right lane is the one the evidence can support.
Use five columns
1. Endeavor: What specific work will continue in the United States?
2. Wider importance: Why does that problem matter beyond one employer?
3. Past record: What shows the applicant can advance this work?
4. Independent proof: Who can verify the contribution without repeating the resume?
5. Forward path: How will the work continue?
Make patents prove impact
An accepted patent proves that an invention exists. It does not, by itself, show practical influence or explain why the invention matters to the proposed endeavor.
For each patent, map the technical problem, the applicant’s contribution, any adoption or evaluation evidence, the practical effect, and the connection to the future work. If adoption evidence does not exist yet, use the patent for the narrower claim it can support.
Turn experience into outcomes
Ten years in the field is background. The stronger evidence is what changed because of the work: safety, reliability, validation time, defect rate, cost, throughput, security, or adoption. Name the baseline, the result, the scope, and the source that can verify it.
Ask every firm the same questions
- What exact proposed endeavor would you use?
- What is the national-importance theory?
- Which facts support each NIW prong?
- What evidence gap creates the most risk?
- Who drafts the petition, and how will the argument and exhibit map be reviewed?
A yes without a case theory is not very informative. A no based only on citation count is not dispositive either.
