A strong NIW record can still fail all three prongs.
Dozens of publications, hundreds of citations, funded projects, clinical trials, and independent reuse can all matter. But a response still breaks when the same facts are repeated under Prongs 1, 2, and 3 without explaining what each fact proves.
Treat the RFE as three proof jobs.
Prong 1: define the future work and its broader prospective impact.
Do not stop at "my field is important." Name the work you plan to do, the outputs it should produce, who can use them beyond one institution, and how that use can be observed. A strong publication record supports credibility. It does not replace a concrete proposed endeavor.
Prong 2: prove that you are well positioned for that exact endeavor.
Career totals are a starting point. The useful row connects one prior project to your personal decision or contribution, the output produced, the measurable result, independent uptake, and the next work you can credibly execute. Ask: who used which result, for what later work, and where is that use documented?
Prong 3: explain the waiver logic.
"I need flexibility" is thin. The response should explain why the proposed work benefits from operating across institutions, why a single-position labor certification is a poor fit for that work, and how the United States benefits from waiving that requirement. Qualified counsel should decide the legal argument.
One practical test catches a lot of weak drafting: if the same citation total, recommendation letter, or project appears in all three sections with no different explanation, the response is probably repeating evidence instead of proving three different points.
Build one control row per officer sentence:
1. Exact RFE sentence
2. Dhanasar prong
3. Evidence already filed
4. New or clarifying proof
5. Personal role
6. Independent uptake
7. Portable output or U.S. use
8. Exhibit and page locator
9. Remaining gap
10. Question for counsel

If you already have an NIW RFE and need the editable evidence-control workflow, review the $99 EB2 NIW Kit: https://chateb1.com/go/eb2-niw-kit?wanted=true&utm_source=substack&utm_medium=web_post&utm_campaign=niw_three_prong_portable_output_20260808&utm_content=bottom_checkout
ChatEB1 provides educational evidence-organization tools. It does not decide eligibility, legal strategy, deadlines, or what belongs in a filing. Keep those decisions with qualified immigration counsel.
